Mobile App Terms of Service

1. Acceptance of Terms
By downloading, installing, or using the Ordare mobile application ("App"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
These Terms apply specifically to consumers using the Ordare mobile application to browse menus and place orders. Merchants should refer to our Merchant Terms & Conditions.
2. Description of the App
The Ordare App allows you to:
- Browse participating restaurant and cafe locations
- View menus, including items, variations, and pricing
- Place and pay for orders for pickup
- Save favorite items and reorder from previous orders
- Save payment methods for faster checkout
- Receive push notifications about order status
- Use gift cards for payment
3. Account Creation
To place orders, you must create an account by providing:
- A valid email address
- Your name
- A mobile phone number
- A password
We verify your account by sending a confirmation code to your email address.
Your mobile phone number is required so that the merchant fulfilling your order can reach you about it, and so that we can secure your account. See Phone Numbers, Text Messages, and Merchant Contact below for how it is used and who receives it.
You are responsible for maintaining the security of your account and for all activities under your credentials. You must notify us immediately of any unauthorized use. You must be at least 13 years old to create an account.
4. Ordering and Payments
Placing Orders
When you place an order through the App, you are entering into a transaction with the merchant (restaurant or cafe), not with Ordare. Ordare acts as an intermediary to facilitate the ordering process.
- Menu items, pricing, and availability are determined by each merchant
- Prices shown include the item price and any applicable modifiers
- Tax is calculated based on the merchant's location and applicable rates
- Orders are subject to the merchant's operating hours and availability
Payments
Payments are processed securely through Square. By placing an order, you authorize the charge to your selected payment method.
- You may save payment methods (credit/debit cards) for future use. Card information is tokenized and stored securely by Square.
- Gift cards issued by participating merchants may be used as full or partial payment
- Tips may be added at checkout at your discretion
- All sales are final once an order is confirmed, except as noted in the cancellation policy below
Cancellation
Order cancellation availability depends on the order status:
- Orders that have not yet been acknowledged by the merchant may be eligible for cancellation
- Once a merchant begins preparing your order, cancellation may not be possible
- Refund policies are determined by each individual merchant
5. User Conduct
You agree not to:
- Use the App for any unlawful purpose
- Provide false or misleading account information
- Attempt to access other users' accounts
- Interfere with or disrupt the App's functionality
- Use automated tools or bots to interact with the App
- Place fraudulent orders or use stolen payment methods
6. Push Notifications
The App may send push notifications to update you on:
- Order status changes (received, in preparation, ready for pickup)
- Important account-related information
- Promotional offers from participating merchants
You can manage notification preferences through your device's settings at any time.
7. Phone Numbers, Text Messages, and Merchant Contact
A mobile phone number is required to create an account. This section explains how it is used and who receives it. Your number is never sold, rented, or leased, and is never shared with advertisers, data brokers, or affiliates. See our Privacy Policy for full details.
Contact from the Merchant
When you place an order, the merchant fulfilling it receives your phone number along with the order so that they can contact you about it – for example, to tell you an item is unavailable, to propose a substitution, or to resolve a problem with your pickup. Your number is also passed to the merchant's point-of-sale system (Square or Clover) as part of the order, where it is stored in the merchant's own account.
- These calls and text messages come from the merchant's own phone or systems, not from Ordare, and are not part of Ordare's text messaging program.
- Under our Merchant Terms, merchants may use your number only to contact you about the specific order it was provided with. They are prohibited from using it for marketing, promotional, or advertising messages, from exporting it or adding it to any list or contact database, and from disclosing it to anyone else. A merchant who violates that has their Ordare account terminated.
- To stop hearing from a particular merchant, contact that merchant directly. Replying STOP to a merchant's message does not affect Ordare's messages, and vice versa.
- If a merchant contacts you in a way that violates these rules, please tell us through our contact page.
Text Messages from Ordare
Ordare uses text messaging for account security only – to verify a phone number you add to your account and to deliver two-factor authentication (2FA) codes when you sign in. Ordare does not send marketing, promotional, or advertising text messages. Promotional offers reach you through push notifications instead, which you control from your device settings as described in Section 6.
- Message frequency: Message frequency varies and depends on your activity. Messages are sent only in response to an action you take.
- Cost: Message and data rates may apply. Ordare does not charge for text messages; any charges come from your mobile carrier.
- Opting out: Reply STOP to any message from Ordare to cancel. You will receive one confirmation message and none after that. Because these messages carry security codes, opting out means you will no longer receive them by text.
- Help: Reply HELP to any message for assistance, or reach us through our contact page.
- Delivery: Mobile carriers are not liable for delayed or undelivered messages.
8. Location Services
The App may request access to your device's location to show nearby participating locations. Location access is optional and can be managed through your device settings. The App functions without location access, though location-based features will be limited.
9. Intellectual Property
The App and its content, features, and functionality are owned by Ordare and are protected by copyright, trademark, and other intellectual property laws. Menu content, images, and business information displayed in the App are owned by the respective merchants.
10. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind. We do not warrant that:
- The App will be uninterrupted or error-free
- Menu information, pricing, or availability is always accurate (this is the merchant's responsibility)
- The quality of food or service from any merchant
11. Limitation of Liability
Ordare is not liable for:
- The quality, safety, or accuracy of food prepared by merchants
- Delays in order preparation or fulfillment by merchants
- Any allergic reactions or adverse effects from food consumed
- Merchant closures, menu changes, or pricing errors
- Any indirect, incidental, or consequential damages arising from your use of the App
12. Third-Party Services
The App integrates with third-party services including Square for payment processing and Twilio for text message delivery. Your use of these services is subject to their respective terms and privacy policies.
13. Termination
You may delete your account at any time. We may suspend or terminate your account if you violate these Terms. Upon termination:
- Your access to the App will be revoked
- Saved payment methods will be removed
- Order history may be retained for legal and operational purposes
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the App or via email. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States. Disputes shall be resolved through binding arbitration.
